2. Services

2.1 We will provide the Services to you as stated on our Website and as agreed in your Booking Deposit Invoice, and you agree to accept and pay the Price in accordance with these Terms.

2.2 On arrival at the Premises your vehicle may be assessed by us. If your vehicle is not as previously described or if additional Services are required or requested, you acknowledge that you may be subject to an increase in Price. We will notify you of any increase in Price prior to work being undertaken and no additional work will be carried out without your consent.

2.3 Time is not of the essence under this Agreement, and we shall use reasonable endeavours to complete the Services within the estimated timeframe specified in the Booking Deposit Invoice.

2.4 We will notify you when your vehicle is ready, and provide you with a timeframe for collection after completion of the Services.

2.5 We reserve the right to refuse to provide the Services at any time.

3. Your Obligations

3.1 When using our Services you agree and undertake:

3.1.1 to provide us with all information and assistance reasonably required to deliver the Services;
3.1.2 to disclose to us any prior work, defects, modifications, custom parts, damage or weaknesses (known or suspected) which may affect the Services;
3.1.3 to co-operate with us;
3.1.4 to provide all permissions and consents required prior to us undertaking the Services;
3.1.5 to comply with any guidance or information provided to you;
3.1.6 to inform us immediately of any changes that may affect our provision of the Services;
3.1.7 unless otherwise agreed, to bring your vehicle to the Premises;
3.1.8 to provide us with the appropriate locking alloy wheel nut key (placed on the passenger seat) for wheel services; and
3.1.9 to ensure your alloy wheels are refitted securely and wheel nuts torqued correctly when collecting your vehicle and to re-check at regular intervals thereafter.

3.2 You shall be liable for, and shall indemnify us against, all expenses incurred as a result of your failure to comply with clause 3.1.

3.3 You confirm you have a spare set of keys for your vehicle. We may need to operate your vehicle to provide the Services, and you acknowledge and consent to us doing so.

4. Our Obligations

4.1 We agree as follows:

4.1.1 where necessary, we will endeavour to carry out the Services as agreed in the Booking Deposit Invoice;
4.1.2 if additional work is required that is not covered by the Services stated in the Booking Deposit Invoice, we will notify you and provide an estimate for that work. If you instruct us to proceed, you agree to pay the estimated amounts or the price calculated in accordance with standard rates.

4.2 We will not perform Services not listed on the Booking Deposit Invoice and will not carry out work in areas that are not agreed, not exposed or not easily accessible unless agreed in writing. Areas that are not easily accessible include (but are not limited to) roofs, undercarriages and inside wheel arches.

4.3 Should we cause damage to your vehicle during the Services, we acknowledge liability for the cost of repairing such damage. Any replacement parts and/or labour required will be sourced and/or performed by us or our contractors. This is your sole and exclusive remedy for any claim relating to damage caused by us.

5. Price

5.1 A non-refundable booking deposit must be paid to secure your booking. The amount is stated on your Booking Deposit Invoice. Your booking is not confirmed until your non-refundable deposit is received. When the Services are complete, the deposit amount will be deducted from your outstanding balance.

5.2 The Price for the Services is as stated on your Booking Deposit Invoice and may be subject to amendment where necessary. We will endeavour to accommodate special requests but do not guarantee this.

5.3 Payment of your outstanding balance is due when you pick up your vehicle after completion of the Services. The vehicle may not be collected until payment in full is made.

5.4 Unless agreed otherwise, outstanding payment will be accepted by card payment only.

5.5 Where full payment is not made in accordance with clause 5.3, we reserve the right to charge interest on any overdue amount at the standard rate. Such interest is without prejudice to any other rights or remedies we may have.

5.6 Any other charges (including bank charges) incurred in connection with payments or recovery of monies for your booking shall be paid by you.

6. Changes

6.1 Changes to the Services booked, including the date and/or time, can be made by giving a minimum of 5 working days’ notice.

6.2 Requests with less than 5 working days’ notice may be accepted at our sole discretion. If changes are not accepted, another deposit may be required to reschedule your booking.

6.3 If you or any third party (not being our sub-contractor) do anything which prevents or delays us from complying with our obligations, we will notify you as soon as possible and shall not be liable for delays. We reserve the right to amend the Price and timeframe where delays occur.

7. Cancellation

7.1 If you are entering into this Agreement as a consumer (meaning you are not acquiring the Services in the course of business), you may cancel by giving notice within 24 hours of your Booking Deposit Invoice being agreed and your non-refundable deposit being paid (“Cancellation Period”), provided that the notice is given more than 48 hours before the scheduled booking commencement. If any Services are provided during this period, you shall reimburse us for incurred costs and we reserve the right to retain the non-refundable deposit.

7.2 If you have to cancel due to unforeseen and unavoidable circumstances, you must notify us immediately. We reserve the right to retain your non-refundable deposit and charge the Price in accordance with these Terms.

7.3 After the Cancellation Period, bookings may only be altered or moved with at least 5 working days’ notice. Changes with less notice may only be made with our permission. If changes are not granted you may proceed with the original booking or cancel. Cancellations in this period will result in the deposit being retained and any new booking treated as a separate booking.

7.3.1 Bookings cancelled with less than 48 hours’ notice or no-shows may incur the full Price for the Services listed on the Booking Deposit Invoice, payable by the original booking commencement date/time (“DROP OFF”).

7.4 If you have saved card details when paying your deposit via the online system used (Elavon), you agree that we may collect payment immediately via these details where permitted by these Terms. Should we cancel your booking due to unforeseen circumstances, we will notify you as soon as practicable.

8. Liability and Indemnity

8.1 We shall not be liable to you or any third party for any loss or damage (including loss of profit, revenue, business, goodwill, anticipated savings (whether direct or indirect), or any indirect, consequential or special damages, losses, costs, claims or expenses) howsoever arising.

8.2 For clarity, we shall not be liable for:

8.2.1 damage or loss resulting from acts of third parties who are not employees or acting under the instruction of our management;
8.2.2 damage or loss if your vehicle is left outside the Premises before or after our opening hours;
8.2.3 damage or loss caused by pre-existing work, modifications, defects, custom parts, damage or weaknesses not disclosed to us;
8.2.4 damage (including “burn-through”) when carrying out wet-sanding/flattening on aftermarket paintwork;
8.2.5 failure to remove embedded dirt/contamination when cleaning wheels; and
8.2.6 damage resulting from unsecured wheels or loose/missing wheel nuts after your vehicle has left the Premises.

8.3 Where we are found liable, our aggregate liability shall not exceed the total Price stated on your Booking Deposit Invoice, whether arising in contract, negligence, misrepresentation, breach of statutory duty or otherwise, except for loss arising from our fraud.

8.4 Nothing in these Terms shall exclude or limit our liability for death or personal injury caused by our negligence or breach of contract.

8.5 You agree to indemnify and hold us, our employees and agents harmless from all liabilities, losses, damages, claims, costs and legal fees arising from your breach of this Agreement.

8.6 We are not responsible for personal items left in your vehicle before Services. While we may endeavour to collect and store such items, it is your responsibility to remove them.

8.7 Vehicle insurance remains your responsibility at all times. We do not insure vehicles while at the Premises.

9. Warranty

9.1 You warrant that you own the vehicle or have authority to enter into these Terms and instruct us to provide the Services.

9.2 We warrant that:

9.2.1 we hold all necessary consents, licences and authorisations to perform the Services;
9.2.2 the Services shall materially conform to their description;
9.2.3 the Services shall be supplied with reasonable care and skill; and
9.2.4 the Services will comply with applicable laws, standards and industry practices.

9.3 Products used during the Services are designed for use on vehicles. While we take care, we shall not be responsible for damage caused by the use of these products.

9.4 You acknowledge we cannot remove 100% of defects, but we endeavour to achieve the best possible result within the estimated timeframe.

9.5 Except as expressly stated, all warranties (express or implied) are excluded to the maximum extent permitted by law.

10. Dispute Resolution

10.1 If you are dissatisfied with the Services, you must advise us within 48 hours; otherwise you will be deemed to have accepted them and waived related claims.

10.2 You should return the vehicle to us promptly in the stated condition for inspection (photographs are not accepted as inspection). You will allow us reasonable time to investigate and rectify any issues.

10.3 If unresolved, you agree to discuss the matter amicably and accept that any agreed resolution will be final and binding.

11. General

11.1 Your Personal Information will be used in accordance with our Privacy Policy at https://www.devoutdetailing.co.uk/privacy-policy/, only to the extent necessary to implement the contract between you and us.

11.2 This Agreement constitutes the entire agreement between the parties and supersedes all previous agreements.

11.3 Neither party shall be liable for delays or failures to perform due to circumstances beyond reasonable control (e.g. strikes, fire, storm, pandemic, government action).

11.4 If any provision is held invalid or unenforceable, it shall be deemed omitted and the remaining provisions shall remain in force.

11.5 Our liability is excluded to the maximum extent permitted by law.

11.6 No variation of this Agreement is valid unless in writing and signed by both parties.

11.7 The parties do not intend any term to be enforceable by third parties under the Contract (Third Party Rights) (Scotland) Act 2017.

11.8 These Terms are governed by the laws of Scotland. By accepting these Terms you submit to the non-exclusive jurisdiction of the Scottish courts.

12. Finance

12.1 We do not directly provide finance. We recommend the provider https://www.payment-assist.co.uk. We have no responsibility for, nor influence over, the finance agreement. You are responsible for ensuring that your chosen payment method is suitable.

12.2 There is no fee for using this service; however, the Price for the Services when financed via Bumper will be charged at the full quoted price and is not eligible for promotions or discounts unless applicable.

12.3 All fixed-price Services are eligible for finance. Once the finance agreement is signed and completed, any additional Services must be paid by card on collection.

12.4 Cancellations or alterations are not permitted once the finance agreement is settled. Cancellation terms in section 7 apply to bookings paid directly to us. Bookings using Bumper finance cannot be changed or cancelled and no refunds will be issued.

12.5 We are not responsible for no-shows or cancellations for bookings made via Bumper. If you cannot attend, we are not obliged to provide the Services, and you will remain liable under the finance agreement.

12.6 We may rearrange your booking at any time. We will try to give as much notice as possible but may cancel at any time and cannot be held liable for financial loss as a result. We will reschedule your appointment if it is cancelled by us.

12.7 Except for cancellation/alteration variations in section 12, all other terms of this Agreement apply whether your booking is financed via Bumper or paid directly to us.

13. Paint Protection Film (PPF) Service Terms

13.1 Drying Time and Care:
Your new PPF requires 3–4 weeks to fully cure depending on weather conditions. Avoid washing your vehicle for the initial 7 days post-installation. Return the vehicle clean for inspection within 1–2 weeks. This is essential for quality control and to rectify any potential installation issues. You must follow our aftercare advice. Poor wash techniques or lack of inspection may lead to failures for which we are not liable. Use of automated/drive-through/public car wash facilities voids any warranty.

13.2 Vehicle Preparation:
The vehicle must not have pre-existing paint protection coatings (including ceramic coatings), as these may affect adhesion. You acknowledge that PPF is designed for OEM factory paint, and installing over non-OEM paint releases Devout Detailing from warranty or damage claims.

13.3 Paint Considerations:
Paint may lift on repainted panels or OEM paint if improperly prepared/painted. You assume related risks, waive claims, and acknowledge that Devout Detailing is not liable for paint damage during installation.

13.4 Paint Chip Management:
PPF is intended to help prevent future paint chip damage. Installing over existing paint chips may result in a visually uneven surface. Touch-ups are recommended before PPF application.

13.5 Exposed Edges and Seams:
While efforts are made to wrap edges, some may remain exposed. Debris buildup may occur over time, especially on white/light vehicles. Ceramic coating is recommended to reduce debris buildup.

13.6 Imperfections:
Due to the nature of the product, minor imperfections may be present in every PPF application. Pre-existing flaws, scratches and rock chips may become more noticeable following installation. While we endeavour to install the film to the highest standard, you acknowledge that there may be visible defects (including air bubbles, dust under film, texture/glue distortion). The primary purpose of PPF is protection; unless the install is significantly sub-standard (several visible defects per panel when viewed from six feet away), removal and reinstallation may incur additional cost.
